These terms and conditions are entered into by and between You and Garden Views Realty, Inc. DBA ResalesDVC
(”Company,” “we,” or “us”).
Please read the these Terms and Conditions carefully before you submit an Auction listing agreement . By
clicking to accept or agree to the Auction Listing Terms and Conditions when this option is made
available to you, you accept and agree to be bound and abide by these Terms and Conditions, our Website Terms Of Use,
and our Privacy Policy, found at Privacy Policy, incorporated herein by reference. If you do not want to
agree to these Terms and Conditions, the Privacy Policy or the Website Terms Of Use , you must not access or use the Website.
This Website is offered and available to users who are 18 years of age. By using this Website, you represent and warrant that
you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you
do not meet all of these requirements, you must not access or use the Website.
Auction Listing Terms and Conditions
Garden Views Realty, Inc. DBA “ResalesDVC” hereinafter referred to as GVR acts as a Transaction Broker for both buyer and seller.
In order for GVR to auction your membership using our auction platform (DVCResaleAuctions.com), we require that you have an
exclusive listing agreement with GVR.
It is the responsibility of the seller to tell GVR when they wish for a membership to no longer be made available for auction. We rely
on your information to be complete and accurate. You, the seller, shall hold GVR and its associates harmless against any misrepresentations
made by you.
We have no control over the bidding process, other than providing a platform that promotes fair and competitive bidding,
so THERE IS NO GUARANTEE THAT YOUR TIME-SHARE PERIOD CAN BE SOLD AT ANY PARTICULAR PRICE.
GVR will not be held responsible for any actual or perceived tampering with the bidding process. We have taken every effort known to us to
prevent this from happening.
Changes to the Auction Listings Terms and Conditions
We may revise and update these Terms and Conditions from time to time in our sole discretion. All
changes are effective immediately when we post them, and apply to all access to and use of
the Website thereafter. However, any changes to the dispute resolution provisions set out in
Governing Law and Jurisdiction (Website Terms of Use) will not apply to any disputes for which the parties have actual
notice on or before the date the change is posted on the Website. Your continued use of the
Website following the posting of revised Terms and Conditions means that you accept and agree to the
changes. You are expected to check this page each time you access this Website so you are
aware of any changes, as they are binding on you.
